US EB-2 India and China Immigrant Visas Exhausted for the Year

Recently, the American Immigration Lawyers’ Association announced that the number of immigrant visas available for EB-2 India and mainland China has been exhausted for this fiscal year.  These visas are subject to an annual limit which was reportedly reached on the 11th April 2012.

The US Citizenship and Immigration Services (USCIS) are still accepting EB-2 India/China adjustment of status applications based on the priority date cut-offs stated in the Department of State”s May and April 2012 visa bulletins.  However, these applications will not be processed until the 1st October 2012 when immigrant visa quotas for the fiscal year of 2013 become available again.

The State Department previously suggested that EB-2 India and China immigrant visas could become unavailable due to high demand within recent months.
