
On October 8, 2025, the government of Brazil published Decree No. 12,657/2025, establishing the National Policy on Migration, Asylum, and Statelessness and amending Decree No. 9,199/2017, which regulates the Migration Law (Law No. 13,445/2017). The new decree sets out the guidelines, principles, and objectives guiding the Federal Government’s actions in the areas of migration, asylum, and statelessness, while also creating mechanisms for coordination among ministries and public agencies.
The bodies responsible for implementing and monitoring the policy include:
- The Federal Executive Committee, responsible for intragovernmental coordination and alignment; and
- The National Migration Council, responsible for social oversight, inter-federative coordination, and action monitoring.
The decree introduces an important amendment to Article 29, §3 of Decree No. 9,199/2017, allowing the provision of technical assistance or technology transfer services—when carried out under a contract, cooperation agreement, or partnership between a foreign and a Brazilian legal entity—to be performed under a visitor visa for stays of up to 90 days, in accordance with current regulations.
