DENMARK – Immigration Changes 2023

The Danish authorities implemented have updated the Danish Alien’s Act, with the below changes will be implemented from 1 April 2023:

Fast Track scheme: Currently Danish companies with a minimum of 20 full time employees may be eligible to register under the Fast track scheme, however under the new changes, this limit has been lowered to a minimum of 10 full time employees. This means that smaller companies may become eligible for the Fast Track registration, provided they meet all other requirements.

Supplementary pay limit scheme: the Danish authorities have introduced an additional pay limits scheme, with a lower annual minimum salary of DKK 375,000. There is no limitation on the job roles applicable in the new scheme, however the new scheme will only remain in place if the unemployment levels do not exceed 3.75% and the job role must be posted on Jobnet and EURES for at least 2 weeks.

Extension of the Positive List: It is anticipated additional job roles wil be added to the existing Positive List, but details have not yet been released. Job roles added to the Positive List will remain for a minimum of 2 years.

Graduate Permits: An automatic permit for foreign nationals who have graduated from a Danish university, with a Bachelor degree or above. The process details have yet to be announced.

Establishment Card Scheme: The Scheme will be replaced by the new Graduate Permit.
