SLOVAKIA: Immigration Changes for 2023

The Slovak authorities have implemented Act No. 5/2004 on 1 January 2023, which included the following changes to immigration processes:

  • In addition to the Posted Worker Notification, Slovak companies will now be required to submit completed Information Cards to the Slovak Labour office at both the beginning and end of an EU national’s assignment/secondment to Slovakia;
  • No Labour market test is required for non-EU nationals applying to renew their Single Permit/Blue Card to continue their employment with the same sponsoring company and in the same position;
  • Non-EU nationals can now continue working in Slovakia whilst their renewal application is being processed, provided the Slovak sponsoring company submits a renewal application no later than 90 days before the expiry date. This includes situations where there is a gap between the expiry of the current permit and the issuance of the new permit;
  • Slovak companies will be required to submit Information Cards to the Labour office when sponsoring a renewal application.

The new requirement to submit Information Cards will be an additional burden to Slovak companies, however the concessions to allow non-EU nationals to continue working whilst their renewal applications are being processed and taking away the requirement to complete a labour market test for renewal applications will be welcome.
