Annual manpower reporting is due in January.
Indonesian companies with foreign employees are required to submit an Annual Manpower Report to the Ministry of Manpower by January 10, 2025. To ensure timely submission, companies should begin preparations as early as mid-December, as the application acceptance period is limited.
Key changes to immigration regulations.
On September 19, 2024, the third amendment to Indonesia’s Immigration Law (Law No. 6 of 2011) was enacted, bringing major changes to the enforcement of immigration regulations. Key changes are set out below.
- Immigration officers will have the authority to prevent foreigners with pending legal or regulatory obligations from leaving the country.
- Holders of Limited Stay Permits (ITAS) and Permanent Stay Permits (ITAP) will receive re-entry permits with a validity period aligned with stay permits. Previously, re-entry permits with a maximum of two years were granted to ITAP holders. Under the new regulations, a five-year re-entry permit can be issued in line with the ITAP’s validity.
- The authority to request information about foreigners staying overnight at lodging facilities has been extended to on-duty police officers. This power was previously limited to Immigration Officers. Lodging providers are now required to share information on foreign guests when requested by either Immigration or the police.
- A cap on the prevention period for foreigners and Indonesians with pending criminal cases has been set at six months but is extendable for another six months.
- The deterrence period is extended to 10 years, with a possibility of a further 10-year extension. This replaces the previous system that allowed deterrence in six-month increments without a defined maximum period.
These changes will require additional regulations from the government. The current provisions remain in place until such regulations are issued.
