UNITED KINGDOM: eVisa Updates to Right to Work Check Requirements

As of 30 December 2021, Appendix D to the full policy guidance on sponsoring a Worker or Temporary Worker or sponsoring a Student has been updated to reflect the introduction of eVisas (a digital version of a visa containing immigration status information) and the associated changes to the right to work check documentary retention requirements.
The updates include the following:
- Amendments to reflect the introduction of eVisas for Skilled Workers – where the worker has been issued with an eVisa only, sponsors must check this, and retain evidence that they have done so, by using the Home Office view and prove service. Where the worker has been issued with both an eVisa and a Biometric Residence Permit (BRP), sponsors can choose which document to check and make a copy of. See Part 2: Sponsor a worker for further information on proof of status.
- Amendments to reflect the introduction of eVisas for Students other than EEA nationals – EEA nationals (who have a biometric passport) applying under the Student or Child Student routes using the ID Check app will receive an eVisa rather than a vignette and a physical BRP. The validity of the Student or Child Student permission will be confirmed on the eVisa. They will be subject to the requirements of the Immigration (Biometric Registration) Regulations 2008.
