BRAZIL: Expedited Processing for Residence Authorisation for Technical Assistance Now Limited to “Urgent” and “Emergency” Cases

On 16 October 2018, the National Immigration Council published Normative Resolution (NR) 34/2018, amending NR 03/2017, which is applicable to foreign nationals who enter Brazil for up to one year to provide technical assistance services while remaining on home contract.

Previously, NR 03/2017 allowed for residence authorisation processing within two days for urgent or emergency work, and within five days in other circumstances, supported by a letter of invitation from the Brazilian host company.

Now, however, the amended rules allow only emergency cases to be processed within two days, and only urgent cases to be processed within five days.

Note that NR 03/2017 does not clearly define the criteria for urgent or emergency work.

Expedited residence authorisation for technical assistance can still only be granted for a maximum of 180 days in a period of one year, although the assignment can be extended up to one year by applying for a new residence authorisation under NR 03/2017.
