INDIA: Employment Visa Sponsorship Requirements

As of September 2016, the Foreigners Regional Registration Office (“FRRO”) in Hyderabad requires established evidence from a sponsor’s business operations in Hyderabad for any foreign workers.

The established evidence will be required when the sponsoring entity in Hyderabad expresses a need to sponsor foreign nationals for an employment visa for India. Fulfilments for such requirements are usually satisfied by the provision of a registration certificate issued by the Registrar of Companies, which shows the registered address for the sponsoring entity. 

It is essential to note however that the matter becomes complicated when the registered address for the visa sponsoring entity is in a location other than Hyderabad. 

In such cases when the visa sponsor needs to employ the foreign national in Hyderabad they are required to provide other government issued evidence. This evidence is essential for proving they are an operating entity within that jurisdiction.  Other such documents may be registration under the Shops and Establishment Act of Telangana State (which is a mandatory requirement for most entities) or any other relevant Telangana State Government body. It is important to note that Hyderabad is a major city in the Telangana state of India. This evidence will be required at the time of registration with the FRRO or when extending the employment visa in India.
