INDONESIA: Change to Validity of RPTKA

Effective 10 December 2018, an RPTKA can only be valid for up to two years initially, rather than five as previously. After two years, the RPTKA can be extended for another period of two years, and after this for another one year.

MOM is understood to have made this change to comply with article 59 of the Indonesian labour law, which states that a temporary employment agreement can have a maximum duration of two years.

RPTKA stands for ‘Rencana Penggunaan Tenaga Kerja Asing’ and is an approval to hire foreign nationals issued by the Ministry of Manpower (MOM).

Our Advice

Employers should be prepared to renew RPTKAs after an initial two years, if required.
