VIETNAM: New Notification Requirement for Early Termination of Work Permits

March 6, 2019

Effective immediately, the Ministry of Labor, Invalids and Social Affairs (MOLISA) has issued a circular which re-introduces the requirement to notify provincial Departments of Labor, Invalids and Social Affairs (DeLISA) of early termination of work permits, and introduces new work permit application forms. Implementation is ongoing and depends on the province.

Early Termination Notification Requirement

No official form has been introduced for this termination notification process, and the labour authorities will only confirm receipt of either the notification report or the original work permit, depending on the province:

  • DeLISA in Ho Chi Minh City request to be notified in writing by the sponsoring entity of early termination of a work permit. The original work permit should be collected and kept by the host entity.
  • DeLISA in Hanoi requests the return of the original work permit if it is terminated early.

No notification is required for a work permit that is terminated because it has expired.
