USA: Revised USCIS Procedures for Green Card Applications

USCIS, in coordination with the Department of State (DOS), have published revised procedures for determining visa availability for applicants waiting to file for adjustment of status (Green card).

From 1st October 2015, it will be possible to submit these applications early, before the priority date for the application becomes current.  This development is expected to benefit applicants in many ways, including enabling them to submit work authorisation applications that go hand in hand with adjustment of status applications, and therefore obtain authorisation to work for any employer while their applications are pending for many months or even years, in some cases. 

It may also enable certain applicants to avoid having to apply for extensions of their temporary work visas, such as H1B or L1. 

Employers and applicants are expected to benefit from greatly reduced administrative and visa filing costs. 

DOS will now publish the monthly Visa Bulletin showing both the Dates for Filing Visa Applications chart and the Application Final Action Date chart.
